Booking Services Terms
BOOKING SERVICES TERMS
1. Definitions:
Services means our recreational activities, Entry Tickets, Party Bookings and any other offerings as detailed on our website or in person.
Entry Tickets means tickets for admission to any Cuto Kids Cafe venue.
Party Bookings means our party packages and related services.
Table/Room Parties means party bookings for a designated table or room within our venue while it remains open to other customers.
Exclusive Venue Parties means party bookings for private use of the entire venue.
2. Agreement: These terms and conditions (Terms) are between Cuto Group Pty Ltd (ACN 658 251 668) (we, us or our) and you, the person booking or purchasing the Services (you or your).
3. Acceptance: You accept these Terms by making a booking or payment with us.
4. Services: We agree to provide the Services to you on these terms and conditions.
5. Entry Tickets
5.1 Purchase:
(a) You may book Entry Tickets through our website, in person, or by contacting us.
(b) Your booking is confirmed once we receive payment.
(c) We reserve the right to decline any booking at our discretion.
5.3 Cancellations and Rescheduling:
(a) You may request to cancel or reschedule an Entry Ticket by contacting us directly;
(b) For cancellations or rescheduling:
(i) with more than 48 hours' notice: you may transfer your booking to another available time,
(ii) with less than 48 hours' notice (or where you are more than 15 minutes late or do not show): your booking will be forfeited with no refund.
6. Party Bookings:
6.1 Types of Party Bookings
(a) Table/Room Parties:
(i) Table/Room Party involves booking a designated table or room within our venue for your event.
(ii) The venue remains open to other customers during your party.
(iii) Minimum guest numbers and fees apply as specified at the time of booking.
(iv) Capacity and duration limits apply as specified at the time of booking.
(b) Exclusive Venue Parties:
(i) An Exclusive Venue Party involves booking the entire venue for private use.
(ii) The venue will be closed to the public during your event.
(iii) Minimum guest numbers and fees apply as specified at the time of booking.
6.2 Duration:
(a) Standard party duration is 2 hours for Table/Room Parties and 3 hours for Exclusive Venue Parties, unless otherwise agreed.
6.3 Payment
(a) A fifty percent (50%) non-refundable deposit is required to secure your Party Booking.
(b) Party Bookings are not confirmed until the deposit is paid.
(c) The outstanding amount is payable at least 2 weeks before the party date.
(d) A 15% surcharge applies to all services and items on public holidays.
(e) Excessive cleaning beyond normal use may incur additional fees.
6.4 Food and Beverage Policies
(a) For Table/Room Parties: All food and beverages must be purchased from the venue, with the following exceptions: birthday cakes, cupcakes, and lolly bags;
(b) For Exclusive Venue Parties: You are permitted to bring your own food and beverages, but a signed Food Waiver is required. Free Starter Kicks and Kids' Meal will not be provided.
(c) Food Orders
(i) Food orders must be placed and paid in full 2 weeks before the event.
(ii) Party menus may change due to seasonal availability.
6.5 Venue Preparation
(a) Table/Room Parties: The party host can arrive 30 minutes before the party time for setup.
(b) Exclusive Venue Hire: The venue will close 1 hour before the party for cleaning and setup. The party host can enter 30 minutes before the party time.
6.6 Decoration Policy
(a) You may bring your own decorations, subject to the following:
(i) all decorations being free-standing (e.g., balloons, banners on stands, table centrepieces).
(ii) if attaching decorations to walls or surfaces, only non-stick Blu-Tack is permitted. No tape,
(iii) you are responsible for any damage caused by decorations. Repair fees will apply for any damage to the venue.
(iv) we reserve the right to remove any decorations that do not comply with these guidelines or that we deem unsafe.
6.7 Cancellations and Rescheduling
(a) You may request to cancel or reschedule a Party Booking by contacting us directly
(b) Rescheduling: you must provide at least 6 weeks notice.
(c) Cancellations:
(i) More than 2 weeks’ notice: The deposit will be transferred to store credit to be used at the Cuto Kids Cafe venue where the Party Booking was made;
(ii) Less than 2 weeks’ notice: The full venue hire fee is forfeited.
(d) In case of cancellation, any payment made for food orders will be refunded if cancelled more than 7 days before the event. If cancelled within 7 days, no refund will be given but food can be collected on the event day.
7. Your Obligations:
7.1 You agree that:
(a) you will comply with our reasonable requests and requirements;
(b) you will provide accurate information to us;
(c) you will not attend if you are suffering from any illness that could risk others' health or safety;
(d) (if applicable) you will ensure all participants in your party comply with these Terms and our venue rules;
(e) you will inform us of any physical or medical conditions that may affect your participation;
(f) you will treat our premises and equipment with respect.
8. Health and Safety
8.1 Socks are required for all adults and children—no shoes or bare feet allowed.
8.2 A waiver must be signed by each participant or their guardian before engaging any recreational activities (see https://www.cuto.com.au/pages/waiver).
8.3 We follow all current health guidelines, including any COVID-19 related restrictions or requirements. These may change and we will inform you of any changes that affect your booking.
9. Payment:
(a) The Prices will be set out on our online booking page or in person when you book.
(b) For Entry Tickets, payment must be made in full at time of booking.
(c) For Party Bookings, a 50% non-refundable payment must be made at the time of booking and the remaining balance is due 2 weeks before the party date.
(d) A 5% late payment fee applies should the outstanding balance of Party Bookings not be paid at least 7 days prior to the event. We can also ask you to pay for any extra costs we face because you didn’t pay on time. This includes any costs to get those payments from you.
10. Liability:
10.1 We will perform the Services with reasonable care and skill. However, we are not liable for any indirect or consequential losses that may arise. Subject to your consumer law rights, our total liability under this Agreement and conditions is limited to the Price paid by you.
10.2 We are not responsible for any loss or damage to personal belongings brought to our venues. Please keep valuable items with you at all times.
11. Recreational Activities:
11.1 In the course of exercising or engaging in any recreational activities while participating in the Services, if you are killed or injured, we will not be liable except to the extent caused by our reckless conduct. A person’s conduct is reckless if the person is aware, or should have reasonably been so, that there was a significant risk that their conduct could result in personal injury and, despite this, engages in the conduct without adequate justification.
11.2 WUnder the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), statutory guarantees apply to the supply of certain goods and services. These guarantees mean that we are required to ensure that the recreational services we supply to you:
(a) are rendered with due care and skill; and
(b) are reasonably fit for any purpose which you, either expressly or by implication, make known to us; and
(c) might reasonably be expected to achieve any result you have made known to us.
11.3 Under the Australian Consumer Law, we are entitled to ask you to agree that these statutory guarantees do not apply to you. If you accept these Terms, you will be agreeing that your rights to sue us under the Australian Consumer Law if you are killed or injured because the Services provided were not in accordance with these guarantees, are excluded in the way set out in these Terms.
12. Changes to Terms: We may update these Terms from time to time. The latest version will always be available on our website. Your continued use of our Services after any changes constitutes acceptance of the new Terms.
13. Governing Law: This Agreement is governed by the laws of New South Wales.
14. Dispute Resolution: In the event of a dispute, the parties will first attempt to resolve the matter through mutual discussion or mediation.
